LOS ANGELES – On October 30, 2019, Carlos Abanto Shinno, represented by MALDEF (Mexican American Legal Defense and Educational Fund) filed an employment discrimination lawsuit against Hewlett Packard Enterprise (HPE). The suit alleged that Abanto Shinno was denied the opportunity to compete for an employment position at HPE because he is a DACA recipient and because of his national-origin.
Since the lawsuit was filed, HPE has demonstrated to MALDEF attorneys that company employment policies do not prohibit the hiring of work-authorized DACA recipients. Indeed, HPE welcomes employment applications from anyone who has work authorization, the company has employed and continues to employ DACA holders, and HPE has been vocal in its support of the DACA program. In light of these and other developments, the suit has now been resolved, through a confidential agreement, to the satisfaction of both parties. The lawsuit has therefore been dismissed.
