MALDEF CONTINUES TO OPPOSE ARIZONA'S ANTI-IMMIGRANT LAW SB 1070

In addition to other violations of the Constitution, SB 1070 violates the First Amendment to the U.S. Constitution, which guarantees all members of society the right to free expression – including solicitation speech. Specifically, Sections 13-2928 (A) and (B) of Arizona's SB 1070 employ content-based restrictions on the rights of day laborers and employers. The provisions impose statewide criminal liability on motorists and individuals based on the individuals' employment solicitation speech.

Earlier this year, MALDEF filed a preliminary injunction to halt implementation of provisions that violate the First Amendment rights of day laborers and employers. This is a First Amendment challenge that is not in the U.S. government's ongoing case against the State of Arizona.

MALDEF will continue to fight against SB 1070 and other copy-cat, anti-immigrant legislation across the nation, ensuring that Latinos are afforded their full rights and equal protection under the law.
